Like Twitter In Nigeria, Facebook Got A Bloody Nose In America

A Supreme Court in America hast ruled that Facebook can be held liable if its platform is used to commit sex offences against children, especially by traffickers whose targets are children.

The court which is a Texas state of American  highest court had ruled that Facebook is not a “lawless no-man’s-land” and could be held accountable. This is coming after three lawsuits were logged at the apex court, all involving underage sex traffic victims.

According to FOX NEWS, The victims were reportedly preyed on through Facebook’s messaging platform.

Prosecutors have claimed Facebook was negligent in not fending off, or better-off, block the sexual predators.

It would be recalled that the Nigerian government versus Twitter face-off is still fresh after the blue bird blogging site deleted president Buhari’s tweets, claiming “was in violation of the Twitter Rules”, prompting the Nigerian government to “indefinitely suspend” twitter all together.

The Nigerian government through her Hon. Minister For Information, Alhaji Lai Mohammed has claimed the government landed the big hammer not because the president’s tweet was deleted, but because twitter activities according to the minister “threatens corporate existence of Nigeria”. And in another public appearance before the Nigerian House of Representatives summon, the minister has also warned that other BIG-TECH companies like Facebook have equal liabilities, and must all register as a recognized business entities under Nigerian’s Corporate Affairs Commission to stand better chances.

But in the case of America, Facebook has contended that it is protected under Section 230 – an internet law that says online platforms are not responsible for thirdparty content posted on the service’s site. While the Texas state Supreme Court in its ruling agreed that “Holding internet platforms accountable for words or actions of their users is one thing, and the federal precedent uniformly dictates that section 230 does not allow it,” but the court found that “Holding internet platforms accountable for their own misdeeds is quite another thing. This is particularly the case for human trafficking.”

Facebook has told Fox Business they are considering “next steps” following the court’s decision, agreeing with the court that “sex trafficking is abhorrent and not allowed on Facebook,” a spokesperson has said.

In the mean time, the Buhari government has constituted a negotiation committee to discuss with twitter, with possibility of lifting the suspension. While the Minister of Information Alhaji Lai Mohammed will chair the team, others are; the Attorney General of the Federation and Honourable Minister of Justice, Honourable Minister of Communications and Digital Economy, Honourable Minister of Foreign Affairs, Honourable Minister of Works and Housing, Honourable Minister of State for Labour and Employment as well as other relevant government agencies .
